Ex partner What will she be entitled to?
0 Answers
My partner had been with this women 1yr when she fell pregnant with there son. they bought a house, but soley in my partners name as she could not obtain credit due to ccj. This was in Aug 98, she left him in May 2000 and took there son. my partner carried on living at the house & received a solicitors letter asking for certain items of the property and he accepted. I've been with my partner since 2003. we had a son in 2004 and during that year ex partner denied access to my partner son, we took ex to court and finally sorted it all out in sept 2005. However, we bought our new house in 2004 in joint names and sold my partners old house (which was soley in his name) in september 2005. We have just received a letter of lies of ex partners solicitors requesting 15 thousand pound of dp house profit and suggests we go to RCM Mediation and if not resolved then she will take us to court. However, she left my partner in debt and owes him nearly 9 thousand pound. He wants to ignore the threat as i know she cannot prove she paid any mortgage? Plus all my partners money is tied in our house. So we decided to ignore and let her take us to court as we dont think she will as it will cost her. She had legal aid when we took her to court over partners son. She claims in her letter she was unable to have a mortgage on account of being unemployed and looking after there son of 5mths at the time, but saved & paid the 5% deposit of the house and then also says she paid the mortgage 2yrs soley from her account. However partners mum & dad paid deposit and the mortgage was paid out of the joint acc they had but she never paid any monies in. He does not wish to go to mediation as he will not sit in the same area as her, partners parents pick take home his son for contact, she has been violent in the past and has been cautioned via the police. any help would be great. x
