Hi, I live in a 2 storey block of flats and my neighbour downstairs has a dog.
According to the lease on the flat you're not allowed pets unless the council have given you permission and my neighbour downstairs did not get permission.
When asked by the council why she has a dog, she told them that she was keeping it for a week whilst the owner was on holiday.
2 months down the line and she still has the dog and it's being a real nuisance. It's barking all day and because there are no grass areas around she doesn't take it out so it pees in the flat. The stench of urine is now coming through our living room floor.
I have rang the council and all they have said they can do is send her letters asking her to rehome the dog (2 letters have been sent, and both ignored) or else they can take her to court, but it'll take a while.
Surely there is a more immediate action that the council can do?
A similiar thing happened to a mate of mine. His next door neighbour had a dog which they kept in their garden and let it bark all night ,keeping him awake. When I seen him in the pub one night he looked dreadful as he hadn,t slept for over a week. However he said he had hit upon a great idea. He was going to steal the dog that night, and keep it in HIS garden. " Let,s see how they f****** like it ," he told me.
I have so much sympathy for you as I have been through this myself. I owned my flat but the lady upstairs was a council tennant and she had two Jack Russells, barked all day and night. Terrible, Terrible. Kept me and my three year old awake.
You could ring your local Enviromental Health officer and tell them. They will probably ask you to keep a diary of times when the dog barks. You can start it now, list everything! Tell the council you are involving them too. Might get their ar$e$ moving. Keep writing to the council and keep copies. My council were useless and they didn't listen until I got the Enviromental people involved, they were brilliant. It may take time but hopefully it will be worth it.

Your neighbour is in breach of their tenancy agreement. for keeping a dog and also for nuisance. they could legally be evicted for this. Chase up tjhe housing officer and get your councillor onto it as well.
