Can he take white goods?

Hi

I have yet another question folks.
Husband and I have split up, he is demanding that I give him the washer, fridge freezer and television straight away.
The washer and fridge freezer are an HP purchase under his name, the tv was a gift.
We have 3 very small children and obviously need these, as at the moment I can't afford to replace them.
Does anyone know if I have to hand these over to him?

i would think so as they are in his name apart from t.v
to me he is behaving very childish
does he pay support for the children?
will he be doing all the washing of the childrens clothes? maybe say if he takes the washer thats what you will expect!

He has only just left. He hasn't shown any interest in seeing the kids and he is very violent (which has been documented by the police)

I'm worried sick that we will be left with nothing. And until I can afford to replace the white goods I need the ones we have.

I'm going to try and get an appointment with a solicitor, but he's demanding the items today, and I doubt I'll be able to get an appointment that quickly,
I would have thought if they're in his name he can take them.

Incidently, whilst they are time savers you don't NEED those things, not in reality. Sure you'll struggle a bit without them, but you can manage without them until you can get your own.

How can I manage with a 5,4 and 1 year old without a fridge freezer and a washing machine????
You could try Freecycle/freegle for second hand working ones so you can just give the white goods to him?
In todays world you don't have to afford them, they are given away free
launderette for washing
I agree you can't do without a fridge but you can do without a freezer
i'm assuming you still have a fridge? so more fresh food rather than frozen.

I'm also assuming you still have a sink? Handwashing. Or taking clothes to your nearest laundrette.

I did'nt say life would be easy without those things, but it can be done, and in all honesty might be a necessity until you can aford to buy your own.
with most people wanting new digital hd tv's people can't sell the old analogue ones.
so you are bound to be able to get one free from someone.

There isn't a laundrette near where we live, I think the nearest one is about 6 miles away.

I speak to a solicitor today.
Let him take them and as there is a history of violence make sure you have a third party in the house.
Then at a later date when you can see a solicitor you may be able to get your t.v back
the other goods are in his name so you wont get them, in the meantime there are places where you can get some really cheap second hand goods look in your local paper somtimes people even give them away in free to collector sections x

by the sounds of it, if your husband is violent etc, it might be better to give him the damn things anyway, thus enabling you to pick up the pieces without him pecking your head for those things? Which on the grand scale of thingfs don't mean diddly.

Just a thought.
Probably better he takes them anyhow.

The other option would be you keep them, he defaults on payments and you start getting visits from the bailiffs.

As B00 says, although convenient, none of the items are essentials.
Just a thought -- do you have any friends , neighbours, family who would be willing to put things in their freezer for you and maybe do a bit of washing to help out.? Best of luck to you and the kiddies.
If they are in his name, then yes. But what kind of a "man" would take those from you and your kids?

Thanks for all the advice.
I've spoken to a solicitor who has advised that he cannot just take things from the marital home that are for the children.
She has advised me to give him his personal belongings and I have an appointment with her on Tuesday morning.
My OH cousin has just been through this. He can't just take things with children in the house. If he tries to phone the police. They take a dim view on this sort of petty behaviour when children are involved.

OH cousins was living with a woman with teenagers. He couldn't get HIS fridge freezer out so he cut the plug off. He got arrested for criminal damage...
Surely a married couple jointly own belongings?
I wouldn't have thought them being in his name has any relevance.
Not everything Hopkirk...but white goods etc tend to be left with the carer of the children regardless who's name they are in.
