if parents die and leave property to siblings, 5 equal shares in the property, and a sum of cash to be equally divided - what happens if 1 of the 5 sibblings also passes away before the will and probate settled?
If both parents die and leave their property to be equally shared between 5 siblings, what if 1 of the 5 also passes away before the will and probate is settled. All 5 where also left a sum of cash also to be devided?

For more on marking an answer as the "Best Answer", please visit our FAQ.As long as there are no survivorship provisions in the Will (ie to my children if more than one in equal shares providing they survive me for * days) and the sibling failed to survive the requisite period, it goes to the sibling's estate to be dealt with under the terms of his will or his intestacy.
