i wonder if you can help i got remarried in July but decided to keep my old married name because it's the same as my children my new husband does not have a problem with this he has two children of his own so he knows where I'm coming from but my ex husband and his new wife does . i have maintenance of him monthly this is areal small amount i know this because my new husband maintain es his two through the csa at quite a substantial amount and this has never been an issue for either of us he is a wonderful father .my ex husband keeps sending a cheque late every month and keeps sending it in my new married name so i can't cash it it then takes another week to get him to send another one in the right name .i don't know what to do i need this money it only pays there dinner money at school per month but it helps hes ab it of a bully so i don't rock the boat as he takes it out on the kids where do i stand legally to make him pay on time i know if it went through the csa he would have to pay more than double but i have been told they wont bother with him cause he pays something

Many married women retain their previous name. It is not illegal to have two names as long as there is no fraud involved. Does anyone know what the legal position is regarding married names? Does a woman automatically take her husband''s name? If so, you will have no problem opening a bank account in your new husband's name. Banks usually require two proofs of id. one of which would be your birth certificate plus marriage certificate to show that your name has changed.
due to the fact he's being a t**t i would talk to the csa. futhermore, set up an account with your hubbys name so that you can cash the cheques. there is no reason not to , i assume you & your new hubby & kids so are not embaressed by his surname. it would only be to get the cash so wouldn't mean anything more than that anyway.

thanks 4 all your help to all . the story is a little more complicated i have recently married my sisters husbands brother so they have the same surname there kids and my hubby's kids have the same name my kids would love to take on there step dads name but don't want to upset there dad so as a compromise i said i would keep there name they do not have any family on there dads side so it seems a sensible solution to me but it's caused all sorts of trouble with my ex and his new wife even after 7 years apart he usually gets his own way but this is one thing i will not back down on i know it's only a bloody name but it means a lot to my kids and they don,.t ask for a lot.
you can legally use any name that is on a cerrtifird copy of an entry in a record of the registrar general. if you were born after 1972(I think it was) your surname is on your birth certificate, if born before you were not given a surname, only your mother and father (if included on the registration) have surnames included, therefore u can leaglly call yourself by either surname. After marriage you can use any name you choose from any of your registrations as long as it is not for illegal purposes and it is the name you will usually be known by. I use my maiden name and married name on the electoral roll mainly so that in future generations if they want to research their family history they will have no problem knowing they have the right ancestor. I have been doing that since 1988.
