is smoking allowed on any part of a pleasure cruise ship?

Hope I'm putting this in the correct section. Yesterday we took a trip on a pleasure cruise ship(don't know if I'm using the correct terminology, but you'll know what I mean) at the coast. There was a bar on board, enclosed, with doors that would close the bar off from the rest of the ship. There were absolutely no "no smoking" signs to be seen anywhere on the ship. People were smoking on the open deck, which I presume is allowed, but also in the bar.
We asked the Captain why the ship was exempt from the new legislation, but he was bemused and said he didn't know, and as far as he knew, they were doing nothing wrong in allowing smoking in the bar. Was the law being broken? To whom should we report it if it is?

If I remember correctly, licensing laws never applied once the boat had reached a certain distance, and could serve alcohol at any time (in the days of afternoon pub closure) - I would if the same applies to the new smoking laws?
