In some cases there obviously won't be a loft space e.g. in a three (or more) storey house or in a two storey building with a flat roof.

In a conventional two storey building (with a sloping roof) there will obviously be some roof space above a first floor flat but access to that space might not be from that flat. Access might, for example, be from a neighbouring flat. Even if there is access to the roof space from the flat it might not be for the use of the tenant or leaseholder. (The access hatch might be kept padlocked by the landlord with permission to use it only being granted, for example, to builders repairing the house).

Note that I've used 'roof space', rather than 'loft' in the previous paragraph. Even if the tenant/leaseholder of the flat can get through an access hatch, he might well find that he's only got into the space below the roof rather than into a proper 'loft' with boarded floors which can be used for storage, etc.
