Tree & Shrub roots

I understand I can lop off branches from neighbours' trees which overhang my property providing I offer them back, but what is the situation regarding tree & shrub roots which come under the fence onto my ground. I am really being bothered by these.   Am I permitted to chop them off, even if this kills the tree or shrub?

the garden law website says yes, but I would suggest a friendly discussion with the neighbour first!

The Garden Law website is basically correct in saying that you don't need your neighbour's permission to remove intrusive roots. What it ignores, however, is the possibility that your neighbour's tree might have a preservation order upon it. If so, you will need the permission of the local authority before doing anything which might be hazardous to the tree.
