I have recently - after a long fought legal dispute erected a new fence along my bottom garden boundary, it's about 4 feet high and complemented with planting & trees. My pain in arse neighbour now wants to erect a 6 foot high fence on his side which will make mine look really stupid, with past history in mind I am reluctant to challenge him, does anyone know the legal position as its my boundary ?

For more on marking an answer as the "Best Answer", please visit our FAQ.So long as he keeps everything on his side, including any concrete footings to the posts and the fence is not more than 2 metres tall, he can do it I'm afraid. This is a very common situation, and the only thing to do is to plan where else you can beneficially use your 4 foot fence, and once he has completed his fence remove your fence and reinstall it there.
Forget the agro. Speak to the guy and try to find some compromise. If as you say, he is going to build a higher fence anyway.
Why dont you do what landie says, mention to the guy about adding trellis but get him to go halfers on the expence. That way everyone is happy.
Unless your fence is a mess I cant see him disagreeing to the compromise.
