Boundry fence

I own the house that I live in, but the house next door belongs to the council. The house next door is on a level which is 3 feet below than of my house. Years ago I voluntarily errected a fence on the top of the retaining wall ( the top of this wall is on the same level as my back door path), because the councils original wire fence had corroded, and I was concerned that without a fence some one could fall down to the level below. The fence is now in need of replacing, which I can't afford to have done since I am now a pensioner. But If I removed this fence it would then become a safety hazard as persons could easily step off my path and fall onto the path below. Who is reponsible for the replacement of the fence me or the council?

Was your home originaly a council home in that case all the fences would have been council owned?

However the very first thing you should do is look at your title deeds, this will tell you if there is any responsablity to fence any boundary.

The ownership of the wall would look to be the council as it is a retining wall, but ther might not be any requirment to fence.
