We are in a property dispute with our neighbours, we have just found out he has a buyer and exchanged contracts. He declared the problem with us to his buyers, but we have found out that he hasn't declared another problem with another neighbour that he has land locked. Though we want the man to go we want to resolve our problems first and are about to start court proceedings (he sold our house to us then become our neighbour)
Where do we go from here, do we still have a case against him as he has exchanged contracts but not yet completed.

He also lied on our sellers form, did not declare previous disputes with other neighbours. We have been bullied for two years. Yes we can't wait for him to go, but at the same time we want him to pay for what he has done to us. Is it Ok that he just sails off into the sunset leaving everyone to sort out the mess. But what is the position now exchange has taken place. waiting to hear from solicitors, but they take forever.
Will do, sorry bitterness and a need for revenge has taken us over. We have both been so stressed and ill because of this man, and now we seem close to getting some sort of justice as it has all taken so long - he's moving. And yippee to that, as nobody could be as bad as him. But we have to sort the problems first, then we can start life again. Thanks for your comments.
The answer is simple. Put a restriction (previously called a charge) on his property. This will prevent his property from being sold until your claim is resolved. You will need a solicitor to ensure that the wording of your application is acceptable without query by the Registrar at the Land Registry. If you act tomorrow (Monday) you could have him blocked by Thursday. Cost around �200.
many thanks everyone. I Phoned the Land Registry to try and get something put on his deeds, but until court proceedings are listed you can't do that. But that will happen soon.
