I received a letter from a solicitor saying that i have encroached on their clients land.

i have lived in my house for six and a half years and have never extended my garden. I today spoke with a neighbour about the letter, and she tells me that 8 or 9 years ago the previous owners extended the garden by about 6 feet.

does anyone know where i stand - do i have to give back the end of my garden which has trees and shrubs growing.

please help.

Well I assume when you bought the property that you used a solicitor and there will be a plan of the boundary of your property. If you can contact the solicitor you used then I think that would be the best way forward. If indeed you have encroached, albeit unintentionally then I am not sure where you stand, maybe you could have a claim for negligence if you thought you were buying more than you did, or if the previous owner misrepresented the extent of the land. You need legal advice to reply to this letter.
You can easily check the situation yourself, you do not need to waste your money on a solicitor. Go here and purchase a copy of the Plan for your property and that of your neighbour. It will cost you 2 x �3. Compare the Plans with the actual layout of your garden - you will see whether or not you are encroaching. Then reply appropriately to the solicitor yourself. If you are encroaching you will have to withdraw without argument.
