have mortgage splitting with partner, advice needed.

Hi, i'm not sure I have posted this in the relevent catagory but really need some advice. I am currently living with my partner and we are both on the mortgage, and have two small children, things have got bad and we are going to split, I don't pay the mortgage or the bills as my partner works full time and i am currently on mat leave for our youngest child, I would like to know whether i have any chance in getting housing benefit to cover a new rented house for myself and the kids if im still on the mortgage, or would i need to get myself off the mortgage first? any advice on this would be greatly appreciated. helen, ps we do have 50K + equity but this is because his dad gave us the money as a gift, hence me not wanting the house, or do not want to make him sell up.

Would your partner financially support your youngest child and the other children, depending on their ages.
If you are still on the mortgage and, in any event, in the property then it could be said that you would more than likely have the right to stay there with the children until they are a certain age so would you get state support?

I'm guessing you can't pay the morgage now as you're on maternity but did you pay the mortgage before and could either of you pay for a mortgage on the property alone for the forseeable future?

I work for a social housing corporation and we don't put people on our waiting list who still own their houses unless they have proof their house is about to be sold. I'd imagine the housing benefit system is even stricter, with your house having to be sold first then proof that your savings are less than a certain amount.
Could you get a part time job that would cover your mortgage and living costs taking into account what you'll get for maintenance from your soon to be ex?
