Property and child custody rights for unmarried father?
I have owned my house for 10 years.My now ex girlfriend lived with me in my house for the past 8 years. Our son is now 7.We split up 6 weeks ago after living separate lives for 3 years. I have moved out but am still paying the mortgage, she is living there with our son. She now wants me to sign the house fully over to her.The house is worth around 90k, the mortgage left on it is 28k and she just wants to take on the 28k mortgage and remove me from any rights to the property/equity.I am seeking a parental responsibility order as I share care of our son.I cannot afford to pay both the mortgage, my rent, and 2 sets of council tax etc.Can I move back in to my house until the legalities are sorted?What would happen if she changed the locks on my house to keep me out?
Her name is not on the mortgage or deeds and she has a new boyfriend she has already moved into my house.We agree our son needs both parents in his life equally but there are obvious issues regarding ownership of my property and future arrangements for living apart. I am seeing a solicitor asap but in the meantime can anybody advise if I have a right to live in my house and ask her to move out to her parents or boyfriends? Thank you.

She is effectivly asking for a �62000 cut of the family finances as apposed to �31000.
I would be inclined to get a specialist solicitor involved as these sort of things can get complicated especially as she wants you to be the one to loose out.
I am not a legal expert by a long shot but if I were you I would pay half the morgage, no other bill but give her child maintanence. Or offer it anyway. I would then put a (minimum) 50% charge on the house so that when she comes to sell you have at least 50% back. With a time limit on when she has to sell by such as when your son have finished full time education or something.
