leaking roof

Our kitchen has a flat roof, when it rains heavily the rain runs down our wall. We called in two roofers for quotes on a new flat roof and surprisingly to us were told the problem was with next doors pitched roof. It had the wrong tiles and set at the wrong angle (some of the tiles point backwards). it had not been pointed off and you could right through from one side to another.

We approached our neighbours and offered to go half on the cost. Mr said ok but Mrs kicked off. she brought her own builder in, who agreed that it was her problem. the costs of the workj incidentally are �220

We continued to try to sort it out amicably and mr did seem keen. we agreed verbally that he would confirm in writing that we could organise the work and would give us cheque for half. the letter never arrived and when I asked Mrs for the letter so we could get it done, she literally screamed at me.

Later that night she threw a piece of paper over the fence giving 'Bob the builder' I'm not joking! permission to fix it. then monday we got home to another letter to say she had had the gap sealed with cement and not to bother her again.

I wrote her a polite letter saying that was not it and if it rained again both I am (probably) my insurance company would be seeking damages through court. Needless to say last nights heavy rain ran down the walls.

Am I in the right here and should I pursue her through court?

although court will offer a solution I would try althernative means before. mainly because legal action has a way of destroying the neighbourly relationship.

I would only deal with the husband in your case, and explain to him clearly the position and try to get something in writing there and then (without the mrs around).

Otherwise, get hold of your insurance company and let them know whats happening. they might offer to send a letter as well
