My landlord and his wife (who both live abroad) have had letters from the local County Court for Order for Possession and a notice of eviction by 15 August. I rent this property from them, through an estate agent. What happens to me?? Im frightened me and my little boy will be evicted by bailiffs! Does anyone know where I stand legally? I signed a 2 year contract from May this year. I can only assume that the mortgage company that they are in debt with do not know that he rents it to me. Also my rent is due soon, do I pay it? I cant believe that only 10 weeks ago my Landlord didn't know that this what happening and went ahead and rented the property out anyway. I'm absolutely gutted. The estate agent is trying to get hold of him. I have spoken to a local solicitor but they want £195! Can anyone help?
I would work on finding somewhere else to live asap.
Did you receive the letters at your house addressed to the landlord?
Perhaps the LL thought the income from your rent would balance out any arrears on his mortgage.
Speak to the estate agent about the rent payments. It would also be worth getting in touch with your local CAB. I'm sure they will be able to help with advice and see if you are able to get some free legal advice.
I received the letters yesterday and it was only by pure chance that I opened one of them by mistake in amongst my mail. Thank goodness I had or I would have been none the wiser.
Go to SAB who will advise you which path to take but I do know you can apply for a stay of execution. A judge will listen to your side of the story, and the fact that you've signed a contract etc etc and award you more time to find somewhere else to live. The amount of time will depend on your needs.
