Neighbours and Trees

I have a tree in my garden whose branches hang over into my neighbour's garden and cause shade. My neighbour has asked if we mind cutting back the branches and says it is our financial responsibility to do so.

Is this true?

My father always tells me that if branches from a neighbours garden hang over into yours then you are entitled to cut them down and throw them back into their garden for them to get rid of as it is their tree.

Your neighbour is incorrect.He may,if he wishes,trim them back to the boundary fence etc;but this would be at his own expense.

He is not entitled however(see above post) to throw them back into your garden,he must dispose of them himself!

not only that, if his overhanging branches fall off and damage your property, or cause damage in some other way,then he is responsible for the damage!

Well dong woofgang so one may cut a neighbour's overhanging branches but one has to return them plus any fruit thereon.  It is what I thought.
