Landlords Dilemma
Hi can anyone shed any light on my dilemma. We own a house that we rent out, we lived in it for three years and decided to move back to our other house to try and sell it. We have now sold it and although we are looking we feel we might have to go back to the rented house we don't like to ask the tenants to leave. What rights do the tenants and the landlord have. They signed a six month agreement.

This will probably be an assured shorthold tenancy which were introduced under the 1988 Housing act and you need to serve on the tenant a section 21 notice (which can be purchased from stationers) which gives at least 2 months’ notice (it can be longer) and can be issued during the fixed period of your intention of possession under section 21, you have to give no reason. As stated by EDDIES & whiskeryron this notice should not take effect during the fixed period of the tenancy which you say is the usual 6 months.
If you have a good relationship with your tenant explain to the tenant why you are taking this action.
