Are Ash Trees Protected?

Hi,

We have a huge Ash tree at the end of our garden and it is only going to get bigger and bigger, it's currently approx 40' high and probably the same wide.

We are considering having it removed but are unsure whether the Ash is protected.

Can anybody advise?

I don't think any entire species is protected but individual trees may have a council preservation order on them. You might come up against opposition because so many ash trees have been lost to a specific disease over the last few years - ash die back I think.

not usually, as far as I know, but you'd best ask your council what their rules are. A neighbour of ours had 20 of them in the garden when she moved in; she took out one every two years, with no council problem..

I don`t think so. Ash trees are in abundance in the South West and I have never heard of anyone who had a problem when they wanted to cut one down.

Your local planning authority maintains the register of all tree preservation orders in your area. You can inspect the records free of charge. If there's no order, then (as long as you don't live in a conservation area) you are free to carry out any work on the tree, including its removal.

If you live in a conservation area (but the tree doesn't have a tree preservation order on it) you must give the local planning authority at least 6 weeks notice of any work you intend to carry out on the tree. The planning authority will then consider whether or not to place a tree preservation order on it.

I'll take advice before doing anything, we're not in a conservation area but as the tree is getting so big it definitely needs some work doing.
