Wall Between My Garden And Neighbours

My neighbour has decided to build a pergola half way down his garden. He has built two posts from breeze blocks which he intends to render; the other 2 posts are wooden. The 2 posts made from breeze blocks he has cemented to my wall. I spoke to him and said I didnt think he was allowed to do that as if he hasnt done the footings correctly, it could damage my wall. His reply was if it cracks I'll repair it! Joined onto the pergola, hes building some sort of outhouse, again from breez blocks and inside he intends to build a wood fired pizza oven. The problem is, the wall he is building this oven against is my garage wall. I have just spent £1000 on a new garage roof and Im very concerned that the heat off this oven will be a fire risk and also could cause damage to the wall. Can anyone tell me what the rules are regarding the wall with his pergola cemented to it and also the rules for a pizza oven. Im sure hes not allowed to build this oven against my garage wall as I dont believe its made of firebricks. I called my local council planning office for informal advice, the guy I spoke to was very unhelpful and basically told me to contact the enforcement officers. I get on well with my neighbours so I just want information so that I can tell him, i dont want the council knocking on the door if we can sort it out between us. Thank you

If its your wall then he can’t use it without your permission. Just go and tell him you are very sorry but owing to your concerns, you don’t give that permission. In all honesty though, I can’t see how you can stay on the same good terms once you have told him he can’t do it.

oh also, if his building works or use thereof cause damage to your property, then he will be personally responsible for all of the consequences.

I agree with Woofters. He can not "attach" structurally to anything of yours without your express permission.

The pergola is out of order, as is the outbuilding containing the pizza oven. They may well be allowable under "Permitted Development", but should be "self-contained". The back wall of the oven must be unattached to your garage.

While he may be allowed to do these without Planning Permission, subject to what I said above, he would need "Building Regulations" approval if the outbuilding is within 1 metre of your boundary.

Also, if the pergola and attached oven-house is over 30 square metres, then he would need Building Regs even if he was 1 metre from your boundary.

Speak to "Building Control" at your local Planning Dept.
