My sister sold her flat last week. She has just had a letter from the buyer saying that they have found damp that was "hidden" behind a wardrobe and that the survey did not pick up and asking for compensation.

She did not know about the dump in the bedroom. She did drop the price of the flat, due to damp in the sitting room. Does she have to pay? I think it is not fair if the survey had not picked it up,and my sis did not know why should she pay? What is her legal situation? Thanks

I wouldn't worry,it is a case of " Buyer Beware" "Caveat emptor"

If they had a survey done then they need to take the matter up with the surveyor or the company they worked for, in short,

Tell them to Get stuffed !!!! Ray
Hi nolnah,

Ray is 100% correct! The surveyor is the one who either didn't do his job properly, or was instructed by the buyer's mortgage lender for a basic survey, which is diddly squat when it comes to checking on everything. No way should she pay anything.

I've said it before and I'll say it again, surveyors = money for old rope!
Sold as seen - its her surveyor the buyer should be persuing if she wants to claim anything, Your sister should tell her to get stuffed
Yeah everyone's right -legally your sister has no liability at all. They have bought the flat and will have to take it up with the surveyor if they want compensation. They are wasting their time contacting your sister.
no liability
you can bet your life the surveyors report begins with at the time of inspection, so thats him covered.
