Hi i have just completed project managment job on a house in london . i tried to get a contract but as we started in such a rush as they where desperate for builder to run job ,i said yes. we agreed 20% total build cost to be agreed . I PUT THIS ON EVERY STATEMENT EVERY WEEK AT BOTTOM OF PAGE SO TO AVOID CONFUSION . i WAS TRYING TO HAVE A MEETING TO DISCUSS THE FEE AND THEY WHERE ALSWAYS BUSY . UNFORTUNATLY I HAVE NOW FINNISHED JOB AND THEY ARE DISPUTING MY FEE THEY SAY 20% TOO MUCH WE WILL GIVE YOU 10%
i HAVE WORKED OUT IF I TAKE 10 % i WAS EARNING LESS THAN 500 POUNDS A WEEK I ALSO WAS STAYING IN BED AND BREAKFAST I HAD TO EAT OUT EVERY NIGHT ,AND STAY AWAY FROM MY HOME AT GTREAT INCONVENIENCE.
MY BED AND BREAKFAST WAS �35 PER NIGHT FOR 5 MONTHS AS LONDON WAS VERY EXPENSIVE THIS WAS CHEAP AS I WAS IN THE KILBURN AREA OF LONDON.
I STARTED MY DAY AT THE JOB AT AROUND 7 - 730 EVERY MORNING AND FINISHED AT AROUND 6 EVERY NIGHT SOMETIMES 8 OR EVEN 9.
DOES ANY ONE KNOW WHAT RIGHTS I HAVE AS THEY ARE BEING AWKWARD IN TALKING ABOUT THE PROBLEM.
DO I HAVE RIGHTS , as i didnt get anything in writing as they where very busy and ssured me they would pay me what i wanted.
i need the 20% but could come to compromise but fear they just want to try it on and get away with paying me.
I always thought i had a contract as soon as i started work its a contract in its own right. And as i stated on statments 20% to be agreed ,i think its unfair for them to negotiate my fee now once i have completed.And 10% is a insult...
If they have agreed to your terms verbally then you have a contract. It doesn't have to be in writing. If I was in your position I would seek formal legal advice with a view to issuing proceedings in the County Court to get the money you deserve. Good luck.
If you need to take them to court try MCOL (Money Claim Online) - cheap and very efficient. Even though you have a verbal contract you may have trouble establishing exactly what you agreed if its not in writing - 'verbal contracts are not worth the paper they are written on'. However, I would send them a summons and hope it frightens them in to paying you - but it can take a while - i have had one going now for nine months without resolution.
