My partner (not married) has decided she doesn't love and and has left with my 2 year old daughter. She says that she doesn't want to fall out but now she wants to move back into the house and has said that if I don't move out then she will get a solicitor to get me out. The mortgage is in joint names but has no equity in it as such as we are redeveloping at the moment. What can I do?

I would speak to a solicitor. Your question may get more answers in body and soul or even law.
whoever has custody of the child is more likely to be able to keep the house tho....
I would have thought, as the child comes first, and needs a roof over his/her head...
maybe you should do the decent thing, if she is bringing up your child alone then don't you want them to be ok?

Your question is ambiguous in that you don't actually say that she's the mother of your daughter, but nevertheless you do need to get some legal advice ASAP.
As others have said, the welfare of the child will be paramount.
Any advice will obviously depend on where you are, as English Law is different to Scots Law or US Law.

lowryder what do you mean the decent thing?shes decided to leave him and now wants the house is it not enough that she took his child and probably hurt him in the process talk about getting left in the gutter.
