I have a property and on the deeds it has a covenant set by the builders and the local council planning dept at the time of build (1982). My question is if part of this restriction i.e. not allowing the planting of a hedge on an open plan front garden, was set by the builder and not come under the local planning laws, as the builder is no longer trading, is this part of the deed enforceable in view that it is not breaching any planning laws.
I have spoken to my local council office and they would only be concerned if it was a fence, and the rule of hedging would have to be taken up with the builders.
