Hi, in relation to my earlier question about eviction under Ground 16... what is the correct protocol for serving a notice? I've had nothing from the council, but there's always that chance that something has gone missing in the post.
To serve a notice of intent to evict, does that have to be physically served and witnessed? Or can they just push it through a letterbox or post it in the mail and claim to have served it?
I'm not sure of exact procedure, but sending it recorded delivery would be a start. they'd be pretty stupid to trust Royal Mail to do the job normally. I would say if they can't show they took reasonable steps to make you aware of the notice and its requirements they're in the wrong and notice may be invalid.
