what right on land at the bottom of the garden.

I have brought a house.The last owner died but he had lived there since 1971.At the bottom of the garden there is a road in the 1960s the council was going to widden the road,but they never have.The garden is 50ft long but were they was going to widden the road the old man used that bit of land,He fenced it off,And so has four other people down the road.They have put trees in a pond.So now the garden is 70ft long.What rights do we have if the council want the land.I have lived there 2yrs but dont forget the last owner looked after the land fenced it off in the 70s.Thanks
