dog attacks through the fence

My neibour's dog keeps making holes in the garden fence and biting my dog. the neibour owns the fence but refuses to mend or stop his dog getting at the fence. I also have two small children and i am worried about there safety. i own my house and the neibour is a tennent of a local housing group which i have spoken to no avail.they insist its tennents responsibilty. what is my legal situation about getting neibour to repair the fence?

I'm willing to be corrected on this but I don't think that there is any law that says your neighbour has to repair his fence.  It is your responsibility to keep the 'nuisance', in this case a dog, out of your garden.

Not sure, but I would have thought if he has a dog in his garden which is obviously dangerous, he would be at fault.

 

Try going back to the housing group and suggeesting that if they do not help you will go to the local papers!. that tends to get them more interested.

 

If that doesn't work, I think you will probably have to go to civil court. Consult your local CAB.

Also check to see if the dog is properly cared for ie: food, water, shelter, etc. You might be able to use that approach to possibly even get the dog removed. It might find a better home. Good luck!

This sounds like a situation that could go out of control, especially with a neighbour who is unwilling to keep his dog under control and a housing group with sloping shoulders.  If I were you, I'd get down to your local Citizen's Advise Bureau.

In farming a farmer is responsible for keeping his own stock from straying. It may be that he is responsible for preventing his dog from roaming ie fixing the fence.

Sounds like you'd get nowhere with this character. Maybe you'd be better putting up a wee bit of fencing yourself to keep the dog out.

If you are concerned about the safety of your children a fence would not be agreat price to pay for peace of mind.  Even chicken wire if dug in and kept taut should do.  I've spent �1,500 this year fencing part of my garden as we now have young children next door and my dogs are very large and used to nobody being there.  You could try CAB, they give excellent free advice

Why not wait by the fence with a lit cigarette, when the dog pokes his nose through stub it out on his nose! He may think twice before doing it again. But seriously, what about putting something natural and smelly down the fence line,, something which dogs hate. I am not good with things like this, but I am sure someone on this forum could help.
