Who is responsible for paying to cut down very tall overhanging neighbours tree?

The person who owns the tree is responsible. However, if it is your neighbour's tree and some of the branches are overhanging your garden, you have the legal right to have them lopped (at your own expense) providing you offer your neighbour the felled wood back afterwards. He cannot be forced to either have the overhanging branches lopped or to pay for the work to be done.
As I sit here looking out of my rear window at a neighbours apple tree which is just coming into leaf, I know I will have another job at the end of the season picking up rotten apples and leaves from my garden. But although I have asked him to cut it back, my pleas fall on deaf ears....THE SWINE, I HOPE IT GETS SOME AWFUL DISEASE.
