The morons next door have a single storey kitchen extension and have installed a wood burning stove in it. The chimney for this comes out of the kitchen roof - and the top of the chimney is level with the bottom of my son's bedroom window on the first floor. When they light this stove my whole house fills with smoke - even with the windows closed. is this chimney legal?

A new chimney requires permission and must meet building regs. and your neighbours should have sought this from your local council. Check with the council. I doubt very much that this would have been approved.
I doubt it Mrs O ................ installation of woodburners and suchlike are covered by Building Regs these days. Building control should have been involved , unless it was installed by a qualified installer............. in which case he should know better.
If you can't get any sense out of Mr & Mrs Moron, then ring your local council and ask for Building Control - General Enquiry.
This might help, endorses what lottie says, and says a chimney outlet must be a minimum of 4.5 metres from the top of the appliance. http://www.stovesonli...tion/bfcma-guide.html
