Building regs - help!

The morons next door have a single storey kitchen extension and have installed a wood burning stove in it. The chimney for this comes out of the kitchen roof - and the top of the chimney is level with the bottom of my son's bedroom window on the first floor. When they light this stove my whole house fills with smoke - even with the windows closed. is this chimney legal?

Building control should have been involved , unless it was installed by a qualified installer............. in which case he should know better.
