My Dad accidently run into the back of someone the other day, all details was swapped but no damage was made. Since then he has had a phone call to say that the other party is claiming on their insurance. Dad doesn't believe that the damage he is saying was caused by this accident, the damage to his car is non existant apart from a small black scuff mark that if he washed the car it would come off. He has sent pictures to the insurance company of his 'damage'. The other party has only been with his insurance company for 2 weeks, and the car was on old T Reg model that wasn't in the best condition anyway. - my pops has told the insurance company this and they have said that they will visit the other party if required. - Pops is really worried about this as he had been driving for 40 years and never claimed on his insurance before.
Has any of you lovely people heard about insurance companies not paying out to the other party and therefore not effected Pop's insurance??

For more on marking an answer as the "Best Answer", please visit our FAQ.It entirely depends on who the insurance company thinks is liable - and unfortunately, there is no excuse in law for running into the back of someone. His best bet is to put in a report to his own insurance company so they can argue the toss with the other bloke's insurance - and to put as much information on his report as he can. It makes no odds that the other bloke's only been with his own company 2 weeks, that's not relevant. Whatever he does, tell your dad not to try to deal with it himself - that's what he pays his insurance premium for. Any letters he gets from the other bloke's insurers should be sent straight away to his own insurance company.
the age of the car is not relevant either, it's still insured to be on the road and still costs money to fix, when someone reversed into my parked car there was no obvious damage until you looked closely and they had pushed the headlight back and under the bonnet slightly which meant the headlight shone at an odd angle, £175.00 to have it fixed.
my car was hit up the back about two weeks ago, we were hardly moving when I hear this bang and immediately knew what had happened, the erring motorist said as he got out of the car theres no damage but there were all scuff marks across my bumper and his front grill was lying in the road, he had not noticed that until I pointed it out to him, luckily I had a 2 witness in my car and they took photos, he was alone. I have been with the same insurance company for 4 years, they sent me to their repair garage for an estimate and the garage pointed out a dent above the bumper ,now the other motorist is disputing it.
Insurance disputes are individual - no two sets of circumstances are the same.
As advised, your dad should contact his insurance company in writing and report the accident from his perspective, and let the two companies sort it out.
Unfortunately, in law, your dad is at faut, and his company may elect to homour the claim.
Tell him not to worry - that is what insurance is for - and there is no gold medal for never making a claim, or having a claim against you.
