Sending Letters Informing Another Businesses Clients Of A Court Case
1 Answers
My company has recently started legal proceedings against another company regarding a breach of intellectual property and for non payment under a software license agreement.
The case is reasonably clear cut with witness evidence but the other company are on the verge of liquidation and as a result they are trying not to pay the large bill and hoping that a flow of new clients will help them pay their debts. The company have had about 6 winding up orders against them during the past 12 months and they always pay up on the day of the court case, however this debt is their largest yet.
They have 1,000’s of clients and they license our software (or parts of it) to these clients. The software is now being licensed illegally as the agreement has now been cancelled but the software is definitely still been licensed. This businesses clients are an innocent party in this and they are providing their clients 9members of the public) with products that contain the software obtained illegally.
Is there anything to stop us from sending letters to these clients detailing that court proceedings have started? These letters would not disclose information but just simply state that court proceedings have started for their information.
