noise pollution

I've recently move into private accomodation above a row of shops( and not being told of the noise that can occur from store activties before hand) . One of these shops is a small corner store which has it's wheelie bins emptied sometimes as early as 4.30am, news papers 1/2 am and lorry deliveries every morning some starting as early as 5.30am. I've asked whether or not they could possibly have later deliveries but i was told i'd get used to it !! What's the law say on times of delivery and how else can i remedy this problem ?

When you live above commercial premises these are the sorts of noises you should have foreseen, or at least asked about before renting the property.

I suggest you speak to your local council and see if you have grounds for complaints of statutory nuisance.

In the meantime some earplugs might help.

Newspaper deliveries are that early in the morning for a reason, so that the customers get their papers early too.
Milk deliveries, bread deliveries etc etc are always early morning drops before the day starts for most people.
The shops will have permission to run those types of businesses and as such will be allowed to have deliveries and thus cause noise at these times. There is nothing you can do to stop the shop going about its business.
I suggest you speak to your landlord about the noise problem if it wasnt mentioned before you moved in.

If you had used a bit of common sense you would have worked this out in advance. It is really obvious that there will be early morning noise associated with businesses such as this. Live with it or move.

I agree with some of what has been said, you knew where you were moving, however I do not think that wheelie bins should be emptied that early and if you speak to your local Council and find out who is emptying them (it might be the Council or it might be a trade waste carrier like Wasteaware or Biffa) and you complain then you might find that they can be persuaded to operate at a more sensible time. Domestic bins are not supposed to be emptied before 7 am and I do not see why the same rules should not apply to the shops.
