can someone please help, my brother was asked to make a statement on an incidedent,hes been accused of glassing a man,which he denies he said he was agueing with one man who was once a friend of his my brother turned his back and one of his friends (other lad) came running at him and started punching my brother my brother swung his arms and caught this lad in head with a bottle he had on him cutting his forehead 2in cut the bottle was then dropped and a fight continued,my brother then walked back to his wife after 10/15 secs of fight then this lad came running across and started again , 7 days later my brother is asked to come to police station, this lad has said he tried to be a peacemaker and stop the aguement then my bro hit him with glass. he has 2/4 witnesses (the lad )all his mates, but in his satament to police he hasent mentioned either fight, my brother got a statment by someone saying this lad started on my bro,hes a anger counceller , he hasent heard from cps yet,2 weeks time,my bro has gbh charge from 20yrs ago ,hes a manager been in job 4 20 years, can someone please give advice

Thats my take on things anyhow..
ryan -I suggest that your brother,if he hasnt got one yet,gets a solicitor pronto.I can see where you are coming from,the fact he hasnt been charged in what in the grand shceme of things is,in his favour.However with Police shifts and such it can take a while before the officers are back on duty to deal with it.Its obviously not being perceieved as a a priority though.
His previous would be taken into account but I personally think the fact he has been of good behaviour since and has held down a job would even if charges were brought be in his favour and the Judge would opt for no-custodial if found guilty.
Try your hardest to get some other witnesses.
