I share a freehold of a house with the lady upstairs. For 6 years we have got on fine, me doing repairs on my flat, her doing repairs on hers. She has a fire escape that come past my window. It is decaying and rusty. The other day a 2' long rusty metal shard was outside my back door, where it had fallen from the fire escape. It looked like an old roman sword that you dig up. It was lethal and pointed at the end. If that had fallen onto me, or someone else it could have killed them. I phoned her up and told her and she came over and had a look. I haven't had any feedback from her and she is weirdly quiet and private.
I am planning on letting out my house and am very worried that if she doesn't fix the fire escape (an expensive job) it could harm someone living in my flat and I will get sued.

Any advice?!

Tell her your fears and intentions....by letter, cc to mortrgage co. Maybe its the cost that worries her, offer to have a welder give an estimate for repairs.
