Hi looking for some help. I've been charged with Breach of the Peace, Assault and Offensive Weapon.
I went out to speak to a neighbour about his loud music and swearing at my wife, the day before the incident and it got a bit out of hand. No blows were struck though he picked up a kiddies aluminium scooter and I picked up a bottle, he then went into his house and returned with a large kitchen knife at which point I returned to my house to phone the police as I was doing this, he was trying to get into my house. With no luck. He then told the police that I attacked him? He has since said that he was at my door with a large spanner, which the police have seized. What's the worst that I could expect if things go wrong for me? The police have one statement apart from my wife's, from a minor who is a friend to my neighbour. I am 37 and have never been in trouble with the police before. My house is up for sale at the moment due to the nuisance. I'm married and have two young children; I'm also the only bread winner in my family. Please help. Thanks.

I cannot fathom how the police have brought charges of assault against you when no blows were exchanged and therefore your neighbour is sporting no visible injuries.
He has openly admitted to his being at your door with a weapon, so if this gets to court, the evidence will speak for itself. A good solicitor will wipe the floor with your neighbour. Good luck, and let us know the outcome.

don't know why chico would apologise for your comment craft, anyway, play the whole thing down as far as the neighbour is concerned, it's not your worry what he's doing, tell the police etc the truth and also contact your local MP about the general nuisance you have experienced, that will go along way to show that there has been a history of trouble you have had to put up with. You would be surprised what that sort of sensible corse of action can do in persuading the CPS not to prosecute.
