unadopted road maintenance?
6 Answers
I have solely been maintaining the unadopted road to my house for the last 14 years, never recieving help or money from anyone, there are two other users of the track, both who moved in after me are farms that access fields from the lane, though they are able to do so through their own properties, they choose for quickness to use the lane.
My question is because they have been damaging and covering the lane sometimes under several inches of mud which I have to wade through to get to my house, do I have any legal right to stop or charge them for repairs or cleanup costs, which I have to undertake regularly?
I have asked them in a neighbourly way to have some consideration, but this seems to fall on deaf ears, somtimes a finantial penalty can have more results. Any constructive advice would be gratefully recieved

who does the road belong to? is it in your deeds that you solely have to maintain it. If it is yours, do the neighbours have right of way over it?

The lane is 3/4 mile long constructed of stone topped with tarmac planings, they won't get stuck as they are in tractors.
I have tried to find out via land registry but no joy as has'nt been sold in last 70years, neighbours have right of access so I believe, to visit their livestock ,though they don't keep stock in these fields and as i said can get to the fields through their own land without using the lane.
Thanks
