have you instructed a solicitor about the issue yet? are they willing to take the matter on a conditional fee agreement of some sort? normally the ATE Insurance is self-insured on PI claims, but i don't really have much experience of dealing with contesting wills and the funding for that. Eddie's guess of a premium of £60,000 is, IMO, way out though. For PI...

I'm not clear then what you want to do- some sort of legal challenge? and why it would need' after the event' insurance. Are you using a solicitor or claims company?
You can't insure against something that has already happened , at least not legally . If you could we would all be millionaires and insurance companies would not exist.
What is 'contentious probate' is it a legal term ?
Claims companies offer policies known as 'after the event' insurance policies though don't they, eddie?

I am very unsure if you could insure against losing a case though and if you could it would cost a fortune.
Apparently you can insure against losing a case, but even the insurance company will only quote on individual cases on individual application there are no guidelines. How ever i would still expect it to be substantial if there was a 50/50 chance of losing £100,000 for example I would expect the premium to be at least £60,000.

For PI claims that cover up to £100,000, the premium is no more than £6,000 in the worst case scenarios and often the premium paid can be lower than £1,000. But like i say, that's on pi matters. Generally though, the defendant's insurers pay the premium as its claimed as part of the costs so our clients don't have to pay the premium, its only payable if the claim is won, and then recovered from the other side (again - in PI matters). Speak to your solicitor, they should be able to explain the way it works as each ate insurer works differently too.....

thank you nini74 youve helped me mentioning the ate insurance. my fears were about the fees for a no win no fee arrangments in the event of losing and incurring oppositions cost, and if won the success costs.ill try to get legal help tomorrow with the insurances included.
