6 Answers
i have recently been involved in an accident where a driver failed to give way, tried to cross the carraigway on which i was traveling, he crossed the broken white lines and i collided with his vehicle, i reported the incident to my insurance company and they said to wait to hear from his, this was seven days ago and i have heard nothing, is there a rule on when he must report to his insurance company so i can begin my claim, my car is undriveable, what do i do next?

In these circumstances your claim is against your insurers under your policy and even in the other driver was uninsured your claim must still be met.
Your insurers may try delaying the progress of your claim until they hear from the Third Partys insurers in order to establish if they have any agreements with them. However, they generally have no right to do so and you should urge them to settle your claim without delay.

As far as I am aware there is no requirement in law for him to report the accident to the police. If he does not report it then you should ask yourself why.Maybe he does not have insurance. In which case your insurance will have to foot the bill
You have passed details to your insurance company let them make enquiries

As a general rule insurers will put a clause in their policy (non-enforcable) to report any accident within 48 hours - it would be great if people did!
Your insurers should be dealing with your claim with immediate effect (assuming you're comp).
It can take some time to recover the money back from the third party insurers due to the rules involved.
Do you know if he was insured? If you have his registration, I can run it through the database

i have now found that the other driver has repoted to his insurance, but as usual he says the blame lies with me, i don't really know what to do next, he was obviously at fault as he tried to cross the main road from a side road and simply did not look.
i do have legal cover on my insurance but the policy is third party, fire and theft, will my insurance company support me in this? as i feel very angry about the fact that he drove without due care and attention and knows it but is trying to blame me, who will fight with me or am i on my own? many people saw the incident but only after they heard the bang, so they did not see the actual collision.
i will keep you posted
