car written off, not my fault but my insurance has lapsed

i was driving on the motorway tonight, a guy drove in to me and wrote my car off. my car insurance had not gone out of my bank as i'd had to move myself and my children out of the marital home following an assault, the house move was expensive so the direct debit didnt go through. what happens now
