Our house insurance with Saga was cancelled before renewal (01June2009) as we did not want them to take direct debits and have to pay an extra premium. We had paid by direct debit free for the first year. Saga kept our bank details and set up another direct debit 03June2009 for the new premium unbeknown to us. When we got our bank statement they had taken a payment from our bank account. We went and cancelled further DD but our bank told us as Saga had our details they could set a DD up anytime as long as they informed us? Surely if we had cancelled the insurance - which they acknowledged - they are taking money illegally?

Probably not 'illegally', but still wrongly. Most of the time it's not illegal to make a mistake which it sounds like what they have done.

Unless it was the final instalment on the old policy?
The DD arrangements are clear that if anything is wrong FOR ANY REASON the bank must refund your money. Just tell the bank that it was taken wrongly and they have to do this.

No - not for ANY reason - but an error is a good reason.

Unfortunately it doesn't stop the payee reinstating the DD.

OP needs to sort it out with Saga as well as the bank.
