dads wife left whats she entitled too?

im asking on behalf of my dad. he has a flat which he owns (all paid no mortgage) his wife left 2 years ago & she is NOT on the deeds nor paid any mortgage, although i suppose she may have contributed to the payment of some of it whilst she was still with him. he has savings & he paid her 12 grand when she left and he thought that was going to be it (that amount is about half of all his saving so he thought he was doing what he was supposed to do legally!?! she made contact last week stating she wants him to sign a document so that she will be entitled to half the share of the sale of the flat on the death of my dad (he is 64 but fitter than me! so maybe a few more years left in him!!!) can she do such a thing? he wants to give her nothing more as she is greedy and he feels that she may not stop at that. she has spent the 12 grand he gave her in less than a year! also he is worried about divorcing her as she may take him for every penny plus more. she did start proceeding for divorce before and told many lies & it looked as though she may get all that she wants, if she lies how can he defend himself? i think she may have layed off the divorce proceedings to butter my dad up so he signs the document for her to have half the value of the flat on his death? i appreciate all your time & advice many thanks xxx

If the answer to my first point is YES then advise your Dad to hold on to his money. Consult a Solicitor.
If the answer to my second point is YES, then your Dad will have some contribution to pay towards any children. If not, then there is no problem. Simply call the woman's "bluff".

Does he have proof that he gave her the money? If so then he should make sure he hangs on to that, has your dad made a will? if not he should have, and then she would not be able to contest it if there were no joint children and he can prove he gave her the 12 K. He could actually include the 12K in his will as a loan not needing repaying if he wanted to be tough!!!! he does not have to support her if she is working, if he supports her and she is claiming benefits his support would be taken into account if it was onoly for her and not for kids too. (I think)
He should wait until he can do a quick divorce and get rid. It will cost a few bob in court fees but she can't have anything from a place she holds no title on. (I think lol)

definitely suggest that he speaks to a solicitor and gets it on record the history of their relationship and the money already paid. she is entitled to something from the time spent together however a court may decide that she has already had more than the value that she contributed to the marriage. your Dad was perhaps foolish to give her money without a court instruction or legal document as this may not be taken into account by the court, even though he thought that he was doing the right thing. In a divorce case, if he contests the claim then his solicitor should appeal to the court citing that she has gives false account. I hope that it all works out for him and he is probably well rid of her. Money grabbing cow!
goodness me you lot are fantastic! everytime i am desperately needing advice and ask there is allways a little angel out there willing to help. you make peoples days, weeks,months... you really are great thank you thank you thanks you. i will pass this info to my dad im sure it will help, he's so scared of losing everything he's worked hard for in his life! luckily they have no children together i was created before thank god!
