my employer put i was unreliable in my ref as i had 3 months off last year due to my mum passing away and also rang the new employer to back up the ref , also told them im under investigaton dueto whistle blowing , which ive had no lette stating that

That is quite bad and dangerous on their part that they have said you are under investigation due to whistle blowing.

If its true then yes they can say it but if it isnt then no she shouldnt have said it
