Yes a judge would usually rule in Tina's favor as the mother, unfair but that's life.

IT would be very unfair seeing that she accepted a large sum of money to be the surrogate. Much more than the amount considered ok for expenses.

Surrogacy is not legally enforceable , if the 'birth mum' decides to keep the child there is nothing to stop her as she is the legal mother . She could be sued for the return of the money paid to her though as she did not fulfill the contract.

Does it make any difference who is the biological mother? For instance, if the adoptive mother had donated her own eggs for the surrogate to carry.

I reckon the baby is full term and Tina was already unknowingly pregnant with Tommy's baby prior to Gary's sperm mixed with Izzy's eggs being placed in her womb. The plot will need DNA to be taken that proves the baby cannot be Gary's and hey presto a happy ending for Tina and Tommy.

Yes surely the hospital would know that the baby wasn't "small for dates", unless it's illness makes it appear smaller.

Any similarity to real life is pure coincidence.
In 'real life' the origin of the eggs or sperm is not significant the ' Mum' is the one who carries the child to term in her womb , the Mum has full legal rights over her child and can keep it if she wants .
Surrogacy give no legal 'right' to the child. If the birth Mum does want to give the child up to the surrogate parents it has to be done by adoption after the birth.
