I have recently had my appraisal at work, a review of my performance in 2007.

I achieved all of my objectives bar 1 (only a small 1) in the year. My only criticisms were that as a manager I should be more forward thinking (this is a manufacturing job in the automotive sector), and I reminded my boss of the old adage about being up to your ar5e in alligators etc etc.

Then the bombshell. He wants me to take on a new role AT A LOWER LEVEL, means I lose perks (bonus, BUPA etc).

Does anyone know if they are allowed to do this?

Of course, they are allowed to get rid of you if they think they have cause and can get away with it. I think it's unfair tho that having raised critiscisms, you don't have the opportunity to take them on board and maybe improve (in there eyes). Is there not some higher level you can appeal to?
Personally, I would think that you might have a claim for constructive dismissal (leaving, based on having employment changes forced on you).

However, I would strongly recommend you gain as many facts as possible (with regards the changes to your employment contract), and discuss your situation with your local Citizens Advice Bureau.

If I were in your situation, I would think that the writing is on the wall, and start looking for alternative employment � do you really want to continue to work for an outfit that treats you like that?

If the loss of salary and benefits is over 25% then it would constitute an fundamental breach of contract and you could make a claim to ET for constructive unfair dismissal. You must have been employed on a contract of employment for 1 year though. They cannot unilaterally impose this on you. You might want to quietly tell them that you know your rights as it sounds as though they don't. Take advice from ACAS or CAB.
