ABH section 47 help

Hi I have just been called to the magistrates court for ABH section 47. a neighbour was minding my child while i was at a day conference, she phned me to say he was upset, hes ten with adha anxiety & autistic features, i went to collect him and she and her neice were really drunk. i took him home and he was upset and said she had threw his rucksack at him. sometimes he takes things to heart so although i was annoyed that she was drunk i was reserving judgement until i could speak to her wen she was sober. he got really upset and said he had left his door key there and he was scared that she might come over so i went to get it. i knocked the door and was let it she threw my key on the floor and wen i went to get it she hit me on the back of the head ( i have curvature of the spine and its stretching my spinal cord which she knows about so she knew it would hurt me I also have lack of feeling in my arms due to nerve pressure. I got up and went out the front door where they followed and i was hit from behind i defended my self pushing and shoving i didnt really know what was going on has i had spots before my eyes and i ears were ringing. they havent stopped ringing since i have been diagonosed with tinitus. she ended up with a bruse to her thigh and 2 black eyes but she has told lies, she didnt mention that she had fell up the stairs earlier and banged her nose, her times are out by around 3 hours she said i was out drinking but i wasnt i was at a work conference and she also says i barged in the house dragged her around then took her outside knocked her out then she said two men appeared split it up and then they both knocked her out. I am woried to death i had to take my son out of school move house miles away because i was being harresed and threatened. her neice who is her witness tried to say that four weeks later i threw a punch at her which was lies and the pps decided not to prosucute on the direction of the police( i live with my son in northern ireland(my family are all in england)i am on disability because of my spine and i am my sons sole carer. I have neverbeen in trouble before and although i am unable to work full time i do work volentary in a oxfam shop. please help im at my wits end and i am not seeing my solicitor till next week. he cant believe its gone this far. the police are always at her door and she is suing the council for tripping over a paving stone and primart for whip lash because the esscalators stopped while she was on it. she has no injurys at all and she admitted to me when we were friends that she justs wants the compensation. i think this is why she is doing this with me because she thinks she will get a pay out of some sort

Even if it did and you were found guilty (even more unlikedly) the chance of a prison sentence is ZERO .
The police are not stupid they know what the other person is like. I am sure that when you see the solicitor he will say you have nothing to worry about.

thanks eddie, my solicitor can not beleive it has got this far and whats even worse is that Ive read though the paperwork and the policeman has not only put my old address on he has also put my new address on his statement. he hasnt put anyone else address and now im really scared the woman his from a large family who have been done for everything from murder to car theft. I had to move to this address because of intimidation the police knew that now i am scared that they will come here. my son is under going therapy because of what she did to him that day and the intimidation that followed, now it seems like it may all start again
You need to see your solicitor and the police and tell them you are feeling intimidated by this family. The police will warn them not to come near you or contact you. It may be possible to get an injunction to stop them contacting you if an injunction is granted they can be arrested if they break it. Talk the solicitor about it.
ive spoke to the pps and they have said that they didnt send her the papers with my address which is a relief. they have also said that their is no over cases ongoing re this woman when i was lad to believ by the police that they was pushing forward for the assault on my son, they said that he was to young and vulnerable to be spoken to but they could go off my statement. all along i have asked for my son to have the chance to say what happened to him but it looks like i was just being thobbed off. my child was assaulted and has had to undergo therapy he can not sleep on his own and he has nightmares and wets the bed and it seems like no one is interested. I have always lived with the belief that the truth wins out in the end but this is so frustrating. How do i explain to my son that the woman who held him in her house assaulted him told him she was gonna kill me then assaulted me is taking me to court. want my son to grow up with respect for the law but how will he under these curcumstances
At the age of 10 your child can speak in court though possibly via a video link.Not certain if the law in N Ireland is diffrent, I know some things are diffrent there. I would just concentrate on providing a safe and secure environment for the child rather than worrying about court cases.
My own son was molested by a lodger who was staying with us for a few weeks and he went to court and gave evidence, but he was 11 at the time and coped very well with it. If your son is too stressed I would just let it go for now and concentrate on looking after him.
