42 Answers
Not sure if this should be on here or motoring, we had trackers fitted to our company cars about two months ago and where asked to sign a form to say if we were caught doing over 70mph we would be fined first £10 then £25 then £50 i gota letter today they have taken £135 out of my months wages, i know they can do this as i signed, but my overspeed report is one incident 9/6/12 time 18:17 76mph . .18:21 74mph.. .18:20 74mph . .18:22 71 mph so i have been fined 4 times for the same incident all within a 5 minute peroid it is the onlt time i have done this and i think to fine me for doing 71 when it could be said i am decellerating it also state on the overspeed report that it was business use when in fact it was the weekend and it was private use, please someone give me some advice this poor underdog is sick of being walked over.

If you havn't signed it yet (or even if you have) make the point that you will only be bound by the agreement if the speedometer in the car is checked, found to be correct (or if not, calibrated) the measuring equipment is also checked and found to be correct on a regular basis (monthly?) or there is sufficient leeway built in to the penalty speed to allow for...

hi thanks for all of your very helpfull replies, my car is not sign written and there is nothing to say that they would be taken readings every 2 mins as it appears, i would have accepted the fines as my error but the one at 71 mph is really taking the p..s, as for setting cruise control in the 1000cc car i'm provided with it has not got a clock never mind a cruise control and surley in my private time it should be up to the police to fine me not the franchise owner.
also he fitted trackers to the vehicles so he could see who was where but one of the male drivers who has a sign written van kept being tracked doing 85 mph and even after a second meeting to discuss his speeds he then left the office and did 85 yet again so this was the only way to stop him speeding i assume.
what i signed said the following important notice, tracker information, our company tracking system provides us with an "overspeed report" this report records the maximum recorded speed of all of our vehicles each time the uk maximum speed limit is exceeded. this limit is currently 70mph. furthermore it goes without saying that all manatory speed limits must be observed, driving in excess of the 70mph limit will not be tolerated and may esult in disiplinary action, there are many reasons for adopting this 70mph limit and examples of such are as follows, #it is against the law to drive in excass of 70mph #it is danerous to drive in excess of 70mph as the probability of having a fatal accident is increased by 50% #thr company has a duty of care to ensure that the 70mph speed limit is not exceeded for both your own safety and the safety of other road users and pedestrians. #fuel usage is increased by up to 15% when driving at excess speeds #driving at excessive speeds in sign written vehicles may bring the company into disrepute. #driving in excess of the speed limit will rener you liable for prosecution and will most probably result in penalty points being added to your licence or in extreme circumstances a driving ban may be applied. this may alter you job possition within the company.
the company prposes to adopt a "fine system" for offenders on a monthly basis and is as follows. first offence-fine £10.00, second offence-fine £25.00, each subsequent offence-fine £50.00
these ammounts will be deducted from your month end wages.
copies of all reports will be available on request. your acknowledgement of this notice is required for your personnel file.

I would suggest a minimum of 25%.
I doubt whether your company will want to go to the expense of having the speedo's calibrated, especially as they will almost certainly be found to have some error and then will either have to be replaced or adjusted at further cost.
Get your workmates to stipulate the same thing.
This is a scheme that starts of as a reasonable idea but has not been thought through.
