My son-in-law works as a mechanic at a garage 6 days a week & has done for over 4 years. He told me at the weekend that his holiday entitlement is only 14 days a year which we both feel is not enough but what are the legalities if this under employment law?
Thank you factor30, it is clear he is entitled to 28 days annual leave so the next question is, is he entitled to holiday in lieu or back-pay for the holidays he has not been allowed over the last 4 years or is that lost? He's probably been very naive over the last 4 years but I think happy to have had a regular & well paid job so the question of entitlement has never arisen, now he knows though, presumably he can force the issue for the coming year?
If I was in that position I'd focus on getting the right number of holidays going forwards and forget about the past. I don't know the legal position, sorry, but I think if he asks now the employer may have to allow him the 2012 extra days- maybe letting him carry them forward.
