Employment Law
I have been off work for 2 and a half month sick. I plan to resign and give in letter on 25.2.12.
My q's are:
1,
I have 119 hours annual leave due - can I request that I get paid out for that? As I will still be booked off sick officially until my final date. (4 weeks from 25.2.13)
2,
I am due to begin training for another job at the beginning of march and my current employer doesn't known this. Can I do this legally?
3, if I can't start training in my new job legally can I ask that I get
Released from my current contract early (ill health) and if so will they still pay my annual leave?
Ps - although I am not fit to return to current job I do believe I will cope fine in new role as it is far less stressful.
My current job is on nhs.

normally yes you would get paid annual leave owing if you are signed off sick until your notice period expires
Howvere, iIf you wanted to leave early to start another job, I know our company would ask that you use annual leave to cover it as you are not sick if you can attend another job.
