incapacity benefit after resignation?

i have been off work with severe depression for several months, i returned to work but couldnt hack it, ie in education. rather than dismiss me , they are prepared to do a deal where i resign and they pay me 3 months salary. once i have resigned and am still too ill to find another job straight away, am i entitled to incapacity benefit or other benefits as, i do know that once you put yourself out of employment usually, you are not entitled to anything for 6 months. but i dont know if i will feel well enough to look for a job at all within the next year.?? help!!

I would ring the Citizen's Advice Bureau if I were you. I was 'persuaded' to resign from a job because of sickness when I was younger. I unfortunately went on to discover that it made getting any sort of incapacity benefit very difficult.

You would be unable to claim for any period where you received money in lieu of notice anyway - or if they paid you for holiday not taken.

Ring the CAB for advice as Hermia suggests. Or go see a solicitor. Or, if your company has a counselling service they may be able to help you.
