I'm not sure she should resign given she disclosed it before her appointment to the cabinet. It raises questions for Sir Keir about why she was appointed.
I suspect there is more to this than what we are given. Highly inlikey Plod would bother prosecuting to a "mistake" let alone get it past the CPS and a conviction.

And that is why she has "resigned". They will be hoping it goes away in a few weeks.
